Intro
“Anything under the sun made by man in Patentable” This is an insightful expression of the US Supreme Court’s patent in the 1980s. There was a background story for this statement.
General Electronic (GE) applied a patent for “oil-eating bacteria” to solve the oil spill incidents.
A Patent application was filed by GE but it was rejected. It was a general understanding that
living things were not patentable subject matter. GE appealed and finally got a patent.
This bacterium was made by transformed genes. US Supreme Court decided that
a patent should be granted under the statement of “living things can be a subject to be patent.
Subsequently, research and invest of bio-industry were increased enormously high.
There are another interesting case at UK. World’s subway map were created and
referred to London underground tube map by Harry beck. On 1933,
Harry Beck thought there was a problem with subway map and he drew up the 45 degrees
both horizontal and vertical diagram subway map and got patent for it.
Now whole world is using his style map.
For case of Korea, on year 1990, right after IMF crisis, ‘F-Killer’ of Samsung Pharm was sold to
Johnson & Johnson, Korea amount of 38.7 billion KRW. At that time, the factory value of
‘F-Killer’ was 9 billion KRW and the brand value was 29.7 billion KRW. Which means
brand value was 3 times bigger than factory value.
Intellectual Property is to put creation into the bowl of law. The desire to create is enriched by
reasonable rewards. In a society where intellectual property is not guaranteed, creativity and
development cannot be expected. Creativity and development can be active when intellectual
property is guaranteed. However, guarantee of intellectual property is relatively weak in Korea.
Korea is well known for active intellectual property application based on patent application standards.
But also has a stigma of infringement on intellectual property in the standard of patent infringement.
Even one company has rough time to get patent, it is very comment for competitors to steal that
patents easily. Also this intellectual property compensation is pretty low. On year 2015,
World Economic Forum (WEF) announced Korea’s intellectual property protection is ranked
68th out of 144 countries. Especially SMEs are weaker than others. Korea Federation of SMEs
reported 51% of SMEs have higher chances to get into patent dispute and 41% are seems to be
defenseless on patent dispute.
Intellectual property disputes are getting serious in worldwide. Samsung and Apple are one of the
good example. Google and Oracle, they had intellectual property dispute over Java-programing case.
In the United States, they are taking serious action by trade retaliation against China’s intellectual
property infringement at the national level.
Now it is important to create fair intellectual property ecosystem between countries and companies.
Intellectual property’s ‘opportunity to create’ should be equal and ‘application processes’ should be
fair and lastly the ‘protection result’ should be defined.
Therefore, Financial News and Korea intellectual property office are hosting ‘the 8th International
Intellectual Property & Industrial Security Conference’ at the Grand Ballroom of
Seoul Westin Chosun Hotel on June 7th, 2018. In this conference, there will be discussion under

For over 25 years, Judge Rader has been a leading thought leader in the field of intellectual property law and jurisprudence. His work as Chief Judge, his publications and his work teaching patent law globally to students, judges and government officials has left an indelible mark on the field of IP law and the protection of IP rights throughout the world. Judge Rader has authored approximately 1000 patent decisions and decided over 3000 patent cases as well as approximately 4000 IP cases in total. Judge Rader was appointed to the United States Court of Appeals for the Federal Circuit by President George H. W. Bush in 1990 and assumed the duties of Chief Judge on June 1, 2010. He was appointed to the United States Claims Court (now the U. S. Court of Federal Claims) by President Ronald W. Reagan in 1988. Before appointment to the Court of Federal Claims, former Chief Judge Rader served as Minority and Majority Chief Counsel to Subcommittees of the U.S. Senate Committee on the Judiciary. From 1975 to 1980, he served as Counsel in the House of Representatives for representatives serving on the Interior, Appropriations, and Ways and Means Committees. Judge Rader stepped down from Chief Judge position on May 30, 2014 and retired from the bench on June 30, 2014. Since leaving the bench, Judge Rader has founded the Rader Group, focusing on arbitration, mediation, and legal consulting and legal education services. Since 2014, Judge Rader has presided over major arbitration under UCC rules in Paris; conducted mediations to settle ongoing litigation; joined law faculty at Tsinghua University; conducted full-credit course at leading law schools in D.C., Seattle, Santa Clara, Bangkok, Seoul, Tokyo, Munich, consulted with major corporations and law firms on IP policy and litigation, and advised foreign governments on international IP standards. He continues to advocate improvements in innovation policy through speaking engagements worldwide. Judge Rader's most prized title may well be "Professor Rader." As Professor, Judge Rader has taught courses on patent law and other advanced intellectual property courses at The George Washington University Law School, University of Virginia School of Law, Georgetown University Law Center, the Munich Intellectual Property Law Center, and other university programs in Tokyo, Taipei, New Delhi, and Beijing. He received a B.A. in English fromBrigham Young University in 1974 and a J.D. from George Washington University Law School in 1978. Judge Rader has received the Gold Medal of LES International in 2014 and has been inducted into the IAM IP Hall of Fame in 2011.
Heli Pihlajamaa, Director Patent Law, EPO Munich, studied Law at Helsinki University and at Max Planck Institute in Munich. Heli acts as legal member in opposition cases and advises EPO higher management on policy issues and legal amendments. She is responsible for supporting the EPO policy by developing, strengthening and promoting the EPC, including proposals for legal changes, compliance of operations with patent law-related norms and case law. Before joining the EPO she worked in both the private and public sectors. Heli has written several books and articles on patent law in Finnish.

Dr. Joo Sup Kim is a Presiding Administrative Judge of IPTAB at KIPO. He is lead judge of the 10th board of complex technology including chemical, mechanical, electrical, optical, and constructional technologies. Dr. Kim was a vice president and head of the team responsible for IP litigation, licensing, counseling, open source and copyright of intellectual property at LG Electronics, Inc(LGE). Dr. Kim`s career in the IP industry spans over 30 years, with extensive experience in IP litigation and licensing at LGE and LG affiliates ( including LG Display and LG Semicon). He has been involved in IP matters covering a number of technologies, including consumer electronics, liquid crystal displays, organic light-emitting diodes, semiconductors, and telecommunications. His expertise includes both offensive and defensive matters through strategic litigation and licensing. He handled over 1,000 litigations and negotiations, among which there are over 50 trials at the court. In addition, he has successfully managed and closed numerous IP transactions, M&A transactions and alliances. He formed a licensing company called Global OLED technologies LLP. He was listed two times as a member of 40 Market makers of Worldwide IP in 2016 and 2017 by IAM. Dr. Kim received a Ph.D., in law from Kookmin University, Korea, a master`s degree in IP law from Franklin Pierce Law Centre in the United States and a bachelor`s degree in electronics and electrical engineering from Hanyang University, Korea.
Prof. Youngtack Shim received his B.S. and M.S. in chemical engineering from Seoul National University and KAIST (both in Korea). Prof. Shim received his PhD in biomedical engineering and JD, both from Duke University (U.S.). He then worked as a patent attorney for the major U.S. patent law -firms such as Fish & Richardson and Pennie & Edmonds. After returning to Korea, Prof. Shim worked as the COO in the Technology Licensing Office at his alma mater (SNU) and then managed “Intellectual Ventures Korea” as the President. Almost for a decade, he then had served his alma mater as the Invited Professor of Law at the School of Law at SNU, while teaching patent law and commercialization. Prof. Shim is now a professor at SUNY Korea (Songdo, Korea), while actively involved in a Korean software startup “Firstface” as the Co-CEO. Inventor Shim is still inventing in anytime and anywhere he sees fit.
Scott Warren is a partner in our Tokyo office and leads a team that specializes in cybersecurity, data privacy and digital data disclosures in Japan and Asia. He advises on digital compliance, eDiscovery and corporate data privacy for global and local corporations. He also has significant experience in compliance, intellectual property, litigation, dispute resolution and government regulatory and internal investigations. He has provided advice to global multinational corporations in the hi-tech, software, retail, healthcare, pharmaceutical, automotive, banking, trading, telecommunications and professional services industries. Scott started his career as a civil litigator in California and is experienced in all phases of disputes resolution, from pleadings through conducting jury trials. He moved to Japan in 1993 and wrote the Japan Employers Handbook for CCH, a large international publishing company. While general counsel at Sega Corporation, he handled various intellectual property issues, including licensing and anti -counterfeiting actions on infringers on every continent except Antarctica. He also oversaw Sega’s internal and regulatory investigations, including anti-competition, US International Trade Commission and safety reporting matters. As senior attorney for Microsoft, Scott was responsible for the Xbox launch in Japan, Korea, Hong Kong, Taiwan and Singapore. He was the head of anti-piracy for Xbox worldwide, head of anti-piracy for all Microsoft products in North Asia and served in the region as the head of Internet Safety, working with law enforcement and governments to better protect the public from cyber threats. He handled internal cyberbreach issues from a legal perspective. In this capacity, he became involved with The Society for the Policing of Cyberspace, a nonprofit organization, where he serves on the executive board. He was the managing director of Kroll in Japan and regional managing director of Kroll Ontrack in Asia, providing clients with investigative, computer forensics and eDiscovery services. Later, he opened Epiq Systems in Japan and built the team and services in order to provide eDiscovery solutions to global organizations. Many of these investigations involved antitrust, bribery, SEC and other regulatory matters. Having served as in-house counsel for more than 13 years and having built two successful legal services companies in Asia, Scott brings a unique understanding, expertise and global perspective to his clients. Scott is also a Certified International Counter-Cyber Crime Professional and is certified as a Member of the Chartered Institute of Arbitrators (CIArb).

Justin Choi is a Professor of ‘Cybercrime & Criminal Investigation’ at the Korean National Police University (KNPU), and also is the Director of the Research and Business Development Center of KNPU. Before joining the KNPU in 2013, Justin was an Assistant Professor of Police Science at the Daejeon University in Korea since March 2011. Justin received his doctorate degree in Security Services from Yongin University in Korea in 2010, completed his master’s degree programs at both the University of Kent at Canterbury [in the U.K.] in 1995 and Yonsei University in Seoul, Korea, in 1993, and got his undergraduate degree in Public Administration from the Korean National Police University (KNPU) in 1987. Prior to his academic career, Justin Choi was the Global Security Director of NHN Corp., currently ‘Naver Corporation’. His responsibilities covered risk management, corporate security, information protection, anti-cybercrime programs, and external relations, including liaison with law enforcement agencies. Justin was the Security Program Manager of IBM Korea, Inc., before joining NHN Corp. in June 2005. He has worked for IBM for seven years, from 1998 until 2005, as the Country Security Manager of Korea. Justin Choi has served eleven years from 1987 as an Inspector with the Korean National Police Agency (KNPA). Justin was seconded to the Presidential Security Service in 1991 as the liaison officer responsible for analyzing foreign intelligence collected and/or reported from a variety of governmental agencies, and then to the U.K. for two years from 1993 to conduct his research study on International Relations. Since 1995, Justin was the East-Asian Regional Contact Officer for the INTERPOL—the National Central Bureau of Korea—in charge of organized and financial crimes, including computer crimes, and also led the founding of 'Hacking Investigations Squad'—the Cyber-Terror Response Center—of the KNPA. Justin received a dozen awards during his corporate career, including one from the CEO & Chairman of IBM, for his efforts and excellent contribution to IBM’s worldwide security programs as part of the IBM’s Security Team during the 27th Olympic Games in Sydney and at the IBM’s PartnerWorld in Las Vegas. Justin has also received numerous prestigious awards during his law enforcement career, including “Top on the List Award” from the Prime Minister of Korea, “Man of Honor Award” from the Commissioner of KNPA, and many others. Justin's credentials include the Certified Information System Security Professional (CISSP) and the Certified Business Continuity Professional, etc. Justin has co-written four books and over twenty-five academic articles in areas ranging from police administration, including cyber- and transnational crimes, to corporate/industrial security. Justin Choi was the 2nd President of Korea Corporate Security Managers’ Council (KCSMC) and the 3rd President of the Korea CPTED Association, and has been the Chair of International Consultants Group on Infra [Security] for UNODC’s “Virtual Forum against Cybercrime (VFAC)” program.
